How do various legal health care documents differ?
Yes and no.The Advance Health Care Directive and the Power of Attorney for Health Care are essentially the same thing. The Advance Health Care Directive is the statutory form mandated by the probate code. The Power of Attorney for Health Care is the old form, or a form that complies with the statute but is simply called something else. The Living Will, however, is not something that is a separate document under California Law. We have never had a Living Will. We have had something called a "Directive to Physicians"; we've had something simply called a "Declaration", which gave instructions concerning when to withdraw life support systems. But those have been repealed, and those instructions are now included in the Advance Health Care Directive and the Medical Power of Attorney.
