No, absinthe is no longer illegal. The absinthe alternatives have always been legal (IE like Herbsaint that has been the popular anise spirit for this drink). As of a few years, true absinthes that use wormword is legal in the US as long as it meets a certain limit of Thujone. I can't really appreciate anise spirits with wormword or not...I've tried expensive absinthe and it's tasted similar to Herbsainte. Especially since this cocktail is just looking for a hint of anise taste, I don't think you need a "refined" absinthe. From what I've researched about this cocktail, the main differences are that the main spirite is rye whiskey (2 oz), and the garnish is a lemon instead of an orange.
