How To Collect Your Judgement When Preparing For Court
Paul Bergman (Professor, UCLA School of Law) gives expert video advice on: How can I collect my judgment?
How can I collect my judgment?
Collecting a judgment is an art all by itself. There are various means of collecting, hopefully if a plaintiff wins a judgment the defendant will say okay and write out a check at the end of trial. If that doesn't happen, if you know where they work you can file what is called an attachment where the Marshall, who is a peace officer, will serve a document on the employer, basically telling the employer to pay part of the wages to you to satisfy this judgment. Sometimes it may take years. Typically a judgment is good for ten years and you can try to collect it at any time during that ten years. If ten years has gone by and you haven't collected it you can renew the judgment for another ten years. And there are professionals whose job is to collect judgments. They track down assets and for a percentage of them they will help people collect judgments.
