How do I defend myself if I am sued for defamation?
Defending yourself in a defamation case is pretty simple. I mean, one defense is the truth. If you're a private figure, is an absolute defense. And then of course, if the plaintiff is a private figure, truth is an absolute defense. Now, in a case of a public official, even if the statement is untrue, the plaintiff still needs to prove that the statement was made with malice, which is a very, very difficult burden to prove. So those are the two main ways you can defend yourself in a defamation case; and it really depends on the plaintiff, whether the plaintiff is a public figure or a public official or whether the plaintiff is a private figure.
