It's something of a complex area, and it's something upon which you should get independent legal advice. If you can agree, once you've informed yourself and your former partner has informed themselves, then fine. But you should actually try to tie that agreement up so there's no comeback. The other thing I'd say is this; mediation may be a way of agreement. If, however, you can't agree, then applications can be made through the court. You can make an application within what's known as the Trusts of Land and Appointment of Trustee's Act. If you're engaged, or were engaged, you can also make an application under what's known as the Married Women's Property Act, but if you do that, time limits apply and you've got to make an application within three years of termination of that engagement.
