Do we need to tell the landlord?
If you're moving into your partner's rented home, you don't necessarily need to tell the landlord. It all depends whether there is anything in the tenancy agreement that requires you to get the landlord's consent to somebody sharing the accommodation with the tenant. It's always wise to tell the landlord that you are moving in, if only because most landlords like to know who's living on the premises.
What happens if someone finds out I have been living there?
If someone finds out that you have been living in your partner's rented property, rented flat or house, and you haven't told the landlord before, the landlord may object to your sharing the property. If that's the case, it's worth asking for the landlord's consent even at that stage, and the landlord will normally give it. In some situations, you may not need the landlord's consent. It all depends on what the tenancy agreement for your partner's property says. It's not necessarily fatal if you haven't told the landlord and they find out at a later stage.
Do we need to change the tenancy agreement?
If you move into your partner's rented accommodation, there's no need to change the tenancy agreement. In some situations, you may want to see if you can have your name put on the tenancy agreement. That will depend on getting the landlord's agreement. The only way to approach that is to tell the landlord that you're thinking of moving in, and ask him if he would agree to add your name to the tenancy agreement so that you now have a joint tenancy.
Can I live there without being on the tenancy agreement?
If you're moving into your partner's rented accommodation, you don't need to be on the tenancy agreement. You could live there without necessarily having your name on the tenancy agreement. The only real issue is whether or not you need the landlord's agreement to live there, and that will depend on what your partner's tenancy agreement says. In some cases, the landlord will want to be asked for his or her consent before you move in, but you certainly don't need to be on the agreement itself.
